Agreement to Terms
These Terms of Service (the "Terms") govern your access to and use of the services provided by UseTina Inc ("Tina", "we", "us", or "our"), including our website, applications, and related offerings (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Description of Services
Tina is a communication assistant for small service businesses that helps manage calls and text messaging with customers, including appointment confirmations, scheduling updates, reminders, and follow-ups.
Eligibility and Accounts
- You must be at least 18 years old (or the age of majority in your region).
- You must provide accurate account information and keep it current.
- You are responsible for all activity that occurs under your account.
Acceptable Use
You may not misuse the Services. For example, you must not: violate laws; harass, abuse, or harm others; attempt to gain unauthorized access; disrupt or overload the Services; or reverse engineer, copy, or resell the Services except as expressly permitted. We may suspend or terminate accounts that violate these Terms.
Subscriptions, Billing, and Cancellations
- Some features require a paid subscription billed in advance per term.
- Subscriptions auto-renew unless you cancel before the current term ends.
- Cancel anytime in your account settings; access continues through the paid term.
- Prices may change; we will notify you of material changes when required.
Payments
You authorize us (and our payment processor, such as Stripe) to charge your selected payment method for fees, taxes, and charges associated with your subscription. You agree to keep payment details accurate and up to date.
SMS Text Messaging
By opting in to SMS, you consent to receive texts (e.g., responses to inquiries, account alerts, appointment reminders, and order updates). To opt out, reply "STOP" to any message. Message and data rates may apply. For help, contactbusiness@usetina.com.
Your Content
You retain ownership of content you submit. You grant us a non-exclusive, worldwide, royalty-free license to host, process, and display your content as needed to operate and improve the Services. Do not submit content you lack rights to use, or content that is illegal or violates these Terms.
Intellectual Property
We and our licensors own the Services, including software, features, designs, and trademarks. Except for the limited rights you receive to use the Services, we reserve all rights.
Third-Party Services
The Services may integrate with third-party services (e.g., payment providers or communication platforms). Those services are governed by their own terms and privacy policies, and we are not responsible for them.
Privacy
Please review our Privacy Policy. By using the Services, you consent to our data practices as described there.
Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service.
Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill. Our aggregate liability for all claims related to the Services will not exceed the amount you paid to us for the Services in the six (6) months preceding the event giving rise to the claim.
Indemnification
You will indemnify and hold us harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law.
Termination
We may suspend or terminate your access if you violate these Terms or if we believe it is necessary to protect the Services or other users. You may stop using the Services at any time. Sections that by their nature should survive termination will survive (e.g., IP, disclaimers, limitations of liability, indemnification, and dispute resolution).
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Before filing a claim, the parties will attempt to resolve disputes informally for 30 days after written notice. If unresolved, disputes will be resolved by binding arbitration on an individual basis under the applicable AAA rules in California, unless a court claim is required by law. Class actions are not permitted.
Changes to the Services or Terms
We may update the Services and these Terms. If changes are material, we will provide notice when required. Your continued use after changes become effective constitutes acceptance of the updated Terms.
Electronic Communications
You consent to receive notices and records electronically and agree that electronic signatures are the same as handwritten signatures for all purposes related to the Services.
